Webhosting24 Affiliate Agreement

Applies to: All participants (“Affiliates”) in the Webhosting24 Affiliate Program.

1. Overview

This Affiliate Agreement (“Agreement”) sets forth the terms and conditions for participation in the Webhosting24 Affiliate Program (“Program”) operated by Webhosting24 (“Webhosting24”, “we”, “us”, or “our”). By joining the Program, you (“Affiliate”, “you”) agree to be bound by this Agreement.

2. Eligibility

To participate, you must:

• Be at least 18 years old,
• Operate a website, social media channel, blog, or similar platform,
• Not be a direct competitor of Webhosting24,
• Provide accurate personal and payment information.

We reserve the right to accept or reject any application at our sole discretion.

3. Affiliate Obligations

3.1 Promotional Standards

You agree to promote Webhosting24 truthfully, professionally, and without misleading or deceptive claims. All promotional materials (e.g., banners, text links, reviews) must comply with applicable laws and reflect our services accurately.

3.2 Ethical Conduct

You shall not:

• Make false, defamatory, or disparaging statements about Webhosting24,
• Use spam or unsolicited communications,
• Engage in cookie stuffing, ad hijacking, or impersonation,
• Use pay-per-click (PPC) ads bidding on “Webhosting24” or our trademarks without written permission.

3.3 Compliance

You are solely responsible for ensuring your activities comply with local laws, advertising regulations, and platform policies.

4. Affiliate Links and Tracking

You will be provided with unique affiliate tracking links. You must use these links correctly to ensure tracking and attribution of sales. Webhosting24 is not liable for untracked referrals due to incorrect link usage or technical failure beyond our control.

5. Commission and Payouts

5.1 Commission Structure

You will earn a commission for each referred customer who:

• Signs up using your affiliate link,
• Becomes a paying customer, and
• Remains active for at least [30] days.

Details on current commission rates are provided in the Affiliate Dashboard.

5.2 Payout Schedule

Commissions are paid monthly once your balance exceeds [e.g., €50], via [e.g., PayPal or bank transfer]. You are responsible for any transaction or conversion fees.

5.3 Withholding and Adjustments

Webhosting24 reserves the right to withhold commissions in the event of:

• Fraudulent signups or activity,
• Violation of this Agreement,
• Canceled or refunded orders.

6. Term and Termination

6.1 Term

This Agreement begins upon acceptance into the Program and continues until terminated by either party.

6.2 Termination

Either party may terminate the agreement at any time, with or without cause, by written notice (including email). Webhosting24 may suspend or terminate your participation immediately in case of:

• Breach of this Agreement,
• Reputational damage to Webhosting24,
• Inappropriate behavior or content.

Upon termination:

• All rights to use our brand assets and links cease,
• Outstanding commissions (if valid and earned) will be paid according to Section 5, unless withheld for cause.

7. Intellectual Property

You may use our provided logos, banners, and promotional materials solely for Program participation. All intellectual property remains the sole property of Webhosting24. You may not alter or misuse any Webhosting24 branding.

8. Independent Contractor

You are an independent contractor. Nothing in this Agreement creates any partnership, employment, or agency relationship between you and Webhosting24.

9. Limitation of Liability

We make no guarantees regarding affiliate earnings or the operation of the affiliate platform. Webhosting24 is not liable for indirect, incidental, or consequential damages.

10. Governing Law

This Agreement is governed by the laws of Italy, with the court of Bolzano (Bozen) having exclusive jurisdiction.

11. Changes to the Agreement

We may update this Agreement at any time. Continued participation in the Program after such changes constitutes acceptance of the new terms. We will notify affiliates of material updates via email or dashboard notification.
